Attorney Krystal Limon successfully argued a post judgment arrears enforcement on February 28, 2011. This matter was held at the San Diego Superior Courthouse, Family Law Division. Wife retained The Edmunds Law Firm to file for arrears in November 2010.
Husband claimed an oral agreement was made in 2007 to settle spousal and child support arrears and current payments owed in exchange for his payment of expenses to the adult children. Since that time the parties did not dispute that Husband had paid approximately $70,000 in expenses for the adult children. Husband provided two declarations from the adult children confirming the agreement. Husband also raised a Quantum Meruit claim for services rendered to Wife. Wife claimed there was no such agreement.
After the hearing on the issue, the Court found there was no agreement and ordered arrearages, including interest, totally approximately $37,000. In addition, the Court denied Husband’s Quantum Meruit claim and ordered attorney’s fees for Wife in the amount of $1,000.
